Fitness Direct (Aust.) Pty. Ltd. ABN 23 151 241 833 may be referred within as; (FDA, we, us, our) recognise the importance of protecting privacy and the rights of individuals in relation to their personal and company information. This document is our Privacy Policy and it sets out how we will handle your personal and business information.

What is personal information?

Under the Privacy Act 1988 (Cth) (Privacy Act), personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not; and whether the information or opinion is recorded in a material form or not. Personal information includes information such as your name, age or contact details.

What personal and business information do we collect and hold?

We may collect and may hold a variety of personal information, including the following:

  • your name, gender, date of birth, residency information;

  • provided and nominated company credit card or debit details

  • Company details, such as ABN, ACN, and ABRN;
  • employment details, such as: occupation, hours of work, employee identification number, employment dates or records of your or your employer’s interactions with us and our representatives, contractors and consultants.

We may also collect information about your membership of trade associations or trade unions which are defined to be sensitive information in the Privacy Act. We will only collect sensitive information with your consent and we will only use sensitive information for providing you with relative products or services of benefit and for marketing operations of your account unless you specifically authorise us to use your sensitive information for another purpose. What personal and business information are we required to collect?

We are required to collect your name, email address, contact phone numbers, business names(s) and ABN/ACN as a standard practice in order for us to conduct our day to day business activities, functions, practices, policies and procedures.

How do we collect and hold your personal or business information?

To whom may we disclose your personal information?

  • Insurance related service providers – organisations that provide business insurance cover for our clients and organisations that provide administration services related to such insurance;
  • Service providers – organisations contracted to provide other consulting services, Accounts Payable and Debt Collection services.
  • Marketing and communications agencies and research and analytics providers – organisations which provide survey, research, analytics and marketing and communications services relating to our Products and Services and our industry;
  • Administrators and advisers – organisations contracted to undertake administration, management and advisory services and other organisations we interact with within the consulting and business services industry
  • IT services – organisations maintaining our information technology systems and providing information technology services; and
  • Our preferred financial services organisations and advice companies that are contracted to provide or assist members with their general and personal advice needs. We will also disclose personal information in circumstances where we are required by law to do so. Those circumstances include:
  • Under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and its Rules, we may be required to provide personal information to AUSTRAC.
  • If you wish to authorise another party to receive information or to undertake decisions on your businesses behalf, you must notify us in writing using the contact details provided below in the ‘How to contact us’ section.

Do we disclose your personal information outside Australia?

We may disclose personal information to entities located outside of Australia (eg. our third party service providers) or to entities who use technology located outside of Australia, for some of the purposes listed above, including:

  • our data hosting and other IT service providers located in, or using technology located around the world
  • other third party service providers located in, or using technology located in, India, the Philippines, the United States of America and the United Kingdom.

In turn, those entities may disclose personal information to other organisations located outside of Australia or to other organisations who use technology located outside of Australia.

We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

How can you access and correct your personal information?

You may request access to any personal information we hold about you at any time by calling us on 1300 763 767 or emailing us via our contact us page. Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it.

We may charge you a fee to cover our administrative and other reasonable costs in providing the information to you. We will not charge you for simply making the request and will not charge for making any corrections to your personal information.

There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal. If you believe that personal information we hold about you or your business is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment then we will add a note to the personal information stating that you disagree with it.

Security and how do we keep your personal information secure?

We take reasonable steps to ensure that your personal information is protected from misuse, interference and loss and from unauthorised access, modification and disclosure. We will regularly audit access to our systems to ensure your personal information is stored and housed securely. We will also take reasonable steps to ensure that third party service providers which help us to provide you with our Services (for example, insurance companies) have privacy arrangements which are consistent with the Privacy Act.

We only keep your personal information for as long as the information is required to provide you with our Services or deal with any enquiries you may have. We will generally keep a client’s personal and business information for a period of at least seven years after they cease to be a client, and during this time we may continue to use or disclose personal information as set out in this Privacy Policy.

As our websites are linked to the internet and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you send to us online. You need to assess the potential risks when deciding whether to use our online services. If you do not wish to transmit information via our websites, there are other ways in which you can provide us with your information, such as by mail, telephone or on-site visit.

Cookies

When you access our websites, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer or mobile device. This enables us to recognise your computer and greet you each time you visit our websites without bothering you with a request to register. However, we may do so in the event of an investigation, where a law enforcement agency may exercise a warrant to inspect the service provider’s logs, or to view your browsing activities on some of our websites that send cookies storing your encrypted client number to your computer.

We will only record your email address if you send us a message, if you choose to provide it to us, or if a third party provides it to us indicating that you may be interested in our Services. We will not add it to our contact list, nor continue to include it in a contact list, if you ask us or our third party service providers not to contact you.

Making a complaint

For any complaints about a possible breach of privacy, please contact our Privacy Officer in one of the ways set out in the ‘How to contact us’ section below.

We request that complaints about breaches of privacy be made in writing, so we can be sure about the details of the complaint. Our Privacy Officer deals with privacy complaints. We will attempt to confirm as appropriate and necessary with you your understanding of the conduct relevant to the complaint and what you request as an outcome. We will inform you whether we will conduct an investigation, the name, title, and contact details of the investigating officer and the estimated completion date for the investigation process.

After we have completed the enquiries, we will contact you to advise the outcome and invite a response to that outcome. If we receive a response from you, we will assess it and advise if we have changed our view. If you are unsatisfied with the resolution of any complaints made to us, you can refer the matter to the Australian Information Commissioner.

1 What qualifications do your Trainers and Presenters have?

Answer:

All our sourced Presenters, Consultants and Trainers are fully recruited and checked. Qualifications are verified along with previous employer and client reference checks. Additionally we ensure that all our contractors, consultants, agents, representatives and staff have a minimum of 5 years relevant industry experience.

2 What countries are you able to extend services to?

Answer:

As our Network and operations currently extends across all Australian States and Territories. We have some of our Brands registered for later use in other countries.

3 Can your company offer short term Consultants or Health Club staff solutions for set periods of time?

Answer:

We are able to fulfill all the needs of your business by sourcing and contracting any required number of consultants and specialists to fulfill your businesses needs for whatever engagement period is required. Our team is also there to mentor your staff and the relevant departments whilst they are engaged with your business.

4 What experience do your consultants have?

Answer:

All our sourced consultants that work directly with health clubs must have held previous relevant positions to their placement area, furthermore our direct sales team are all trained prior in our “Selling Fitness” – Direct Sales Modules prior to working with your brand
